It is in the interest of the public to prevent obstructions of the public roads, both for their maintenance and for the safety of the traveling public. Nebraska law prohibits planting crops and placing obstructions within County rights-of-way. This restriction is established under Nebraska State Statute §39-301, and violations may result in prosecution.
Landowners and tenants are required to take immediate action to remove any crops or other obstructions within County rights-of-way. If obstructions are not cleared, such as hay bales, vehicles and posts, the County may remove them and seek reimbursement for all associated costs from the responsible party.
